Common use of WORKER’S COMPENSATION OR OCCUPATIONAL DISEASE ACT Clause in Contracts

WORKER’S COMPENSATION OR OCCUPATIONAL DISEASE ACT. (a) An employee who is entitled to the benefits of the Workers’ Compensation or Occupational Diseases Act of the State of Illinois may claim either such benefits or any sick leave he or she has accumulated or both. However, in the event that both sick leave and Worker’s Compensation Act or Occupational Diseases Act are claimed, the Board shall deduct from the sick leave payments all benefits received by the employee under either the Illinois Worker’s Compensation Act or the Illinois Occupational Diseases Act. (b) If an employee is not working and is eligible for Worker’s Compensation, vacation time shall not be lost and shall remain available to the employee for use as per contract.
