WPS’ Tax Delinquency. If WPS has delinquent Wisconsin tax liability, its compensation due under this AGREEMENT may be offset by ETF upon request of the Department of Revenue in the amount of any such delinquent Wisconsin tax liability, subject to WPS’ rights and remedies available under STATE statutes and rules.
