Common use of WRONGFULLY SUSPENDED OR DISCHARGED Clause in Contracts

WRONGFULLY SUSPENDED OR DISCHARGED. 14 A. If, after review of a suspension or discharge, it is mutually agreed that an 15 Employee who was suspended or discharged was completely blameless of charges regarding the 16 offense, s/he shall be reinstated to his/her former position without loss of seniority and will be paid 17 wages lost as though s/he had not been suspended or discharged. No entry shall be made on the 18 Employee’s record of such suspension or discharge. 19 B. If, however, after such a review, it is found that the Employee in question was not 20 completely blameless, then the PARTIES may mutually agree upon a reduction of the penalty and 21 upon what, if any, portion of the wages s/he would have earned should be restored to him/her. 23 24 25 26 27 28
