Common use of Wyoming Customers Clause in Contracts

Wyoming Customers. This Agreement shall be governed by, and construed and enforced in accordance with, the laws of the State of Wyoming. If Brightstar cancels this Agreement, Brightstar shall deliver a written notice to the Subscriber at the last known address of the Subscriber contained in the records of Brightstar at least ten (10) days before the cancellation effective date. Prior written notice of Brightstar’s cancellation of this Agreement is not required if the reason for cancellation is a nonpayment of the Service Fee, a material misrepresentation by the Subscriber, or a substantial breach of duties by the Subscriber relating to the Covered Product or its use. In the State of Wyoming, arbitration proceedings shall be conducted in accordance with the Wyoming Arbitration Act and arbitration can only be final and binding if agreed to by the parties involved in a separate written agreement.
