Common use of Xxxx Atlantic Retail Telecommunications Clause in Contracts

Xxxx Atlantic Retail Telecommunications. Services may be purchased by Reseller under this Agreement only for the purpose of resale by Reseller as a Telecommunications Carrier providing Telecommunications Services, pursuant to Section 251(c)(4) of the Act, 47 U.S.C. Section 251(c)(4). Xxxx Atlantic Retail Telecommunications Services to be purchased by Reseller for other purposes (including, but not limited to, Reseller's own use) must be purchased by Reseller pursuant to separate written agreements, including, but not limited to, applicable Xxxx Atlantic Tariffs. Reseller warrants and agrees that Reseller will purchase Xxxx Atlantic Retail Telecommunications Services from Xxxx Atlantic under this Agreement only for the purpose of resale by Reseller as a Telecommunications Carrier providing Telecommunications Services, pursuant to Section 251(c)(4) of the Act, 47 U.S.C. Section 251(c)(4).
