(iv. ) In case the Bidder, submits false certificate in terms of any documents supported in support to this Tender.
v. (v) If the Bidder fails to sign the Contract in accordance with Conditions of Contract on receipt of LoA.
(vi. ) In case the Bidder is found to indulge in corrupt or fraudulent practices at any stage of the execution of the contract.
(vii. ) If the Bidder fails to furnish the Performance Bank Guarantee in accordance with Conditions of Contract.
(viii. ) In case of a Bidder revoking or withdrawing his Tender or varying any terms of the Bid without the consent of the Employer in writing.
(ix. ) In case of forfeiture of EMD, as prescribed from (i) to (viii) above, the Bidder shall not be allowed to participate in the retendering process of the work.

XXXXXXX MONEY DEPOSIT (EMD). 6.1.1 6.1.1. All Bidders shall furnish EMD of the amount as mentioned in Section III: Bid Data Sheet. However, Micro and Small Enterprises (MSEs) as defined in MSE Procurement Policy issued by Department of Micro, Small and Medium Enterprises (MSME) or Start-ups as recognized by Department for Promotion of Industrial and Internal Trade (DPIIT) are exempt from submitting the EMD on submission of documents to the extent as per the Government of India notifications in this regard. 6.1.2 6.1.2. Bids not accompanied by EMD shall be rejected as non-responsive.

6.1.4 6.1.4. The EMD of those Bidders whose Financial Bids have been opened but are not selected as “successful Bidder” would be returned within seven days of issuance of Letter of Acceptance (LoA) to the successful Bidder.
6.1.5 6.1.5. The EMD of Bidders who have not qualified for opening of Price Bids in terms of clause 3 & 16 of ITB would be returned within seven days of opening of Price bid.
6.1.6 6.1.6. The EMD shall be forfeited by the Employer in the following events:
i. (i) If Bid is withdrawn during the bid validity period including any extension agreed to by the Bidder thereof.
(ii. ) If the Bid is varied or modified in a manner not acceptable to the Employer after opening of Proposal during the validity period or any extension thereof.

(iii. ) If the lowest Bidder raises any fresh issue and / or T&C after opening of bid and prior to signing of agreement, it will be construed as withdrawal of the original bid and in that case EMD is liable to be forfeited.
(iv. ) In case the Bidder, submits false certificate in terms of any documents supported to this Tender.
v. (v) If the Bidder fails to sign the Contract in accordance with Conditions of Contract on receipt of LoA.LoA or withdraws the bid.
(vi. ) In case the Bidder is found to indulge in corrupt or fraudulent practices at any stage of the execution of the contract.
(vii. ) If the Bidder fails to furnish the Performance Bank Guarantee in accordance with Conditions of Contract.
(viii. ) In case of a Bidder revoking or withdrawing his Tender or varying any terms of the Bid without the consent of the Employer in writing.
(ix) Authority may also blacklist or debarred the bidder in participating in the IWAI tendering for 02 (two) years as prescribed from 6.1.6. (i) to (viii) above.
(x) In case of forfeiture of EMD, as prescribed from (i) to (viii) above, the Bidder shall not be allowed to participate in the retendering process of the work.

6.1.5 The EMD of Bidders who have not qualified for opening of Price Bids in terms of clause 3 & 16 of ITB would be returned within seven days of opening of Price bid.
6.1.6 The EMD shall be forfeited appropriated by the Employer Owner in the following events:
i. (i) If Bid is withdrawn during the bid validity period including Bid Validity Period or any extension agreed to by the Bidder thereof.
(ii. If the Bid is varied or modified in a manner not acceptable to the Employer after opening of Proposal during the validity period or any extension thereof.
a. ) If the Bidder tries to influence the evaluation process.
(iii. ) If the lowest first ranked Bidder raises any withdraws its Bid during negotiations (failure to arrive at consensus by both the Parties shall not be construed as withdrawal of Bid by the Contractor). Any fresh issue and / or T&C after opening of bid and prior raised by the Contractor pertaining to signing of agreement, it the contract price (apart from mutually agreed price change) will be construed as withdrawal of the original bid quotation and in that case liable for forfeiture of the EMD is liable to be forfeitedby the Bidder.
(iv. ) In case the Bidder, submits false certificate certificate(s) in terms of any supporting documents supported to this Tenderthe Bid.
v. (v) If the Bidder fails to sign the Contract contract in accordance with Conditions conditions of Contract contract on receipt of LoA.
vi. In case the Bidder is found to indulge in corrupt or fraudulent practices at any stage award of the execution of the contractwork.
vii. (vi) If the Bidder fails to furnish the Performance Bank Guarantee in accordance with Conditions conditions of Contractcontract.
viii. (vii) In case of a Bidder revoking or withdrawing his Tender its Bid or varying any terms of in regard thereof after the Bid Due Date without the consent of the Employer Owner in writing, the EMD paid along with the Bid shall be forfeited by the Bidder.
ix. 6.1.6 In case the event a bidder has not submitted EMD in terms of forfeiture this ITB, upon happening of EMD, as prescribed from (i) to (viii) any of the event specified in Clause 6.1.5 above, an amount equal to the Bidder EMD shall not be allowed payable to participate in the retendering process of the workOwner.
