Zoning Requirements. Incumbent shall be responsible for compliance with all zoning requirements applicable to the System and its Facilities, including, but not limited to, the Leased Premises. Incumbent shall advise PathNet of zoning requirements, which, in the reasonable opinion of Incumbent, differ from those generally applicable to microwave facilities. PathNet shall provide to Incumbent all required information and shall cooperate with Incumbent in connection with Incumbent's compliance with all zoning requirements pursuant to this SECTION 10.2.
Zoning Requirements. Subtenant shall ensure that the use of the Subleased Premises conforms to all governmental and municipal zoning requirements.
Zoning Requirements. There is a zoning ordinance within the Village of Fredericktown. Some common items that need building permit applications filed are: new construction, additions, accessory buildings, fences, and swimming pools. Pools require a new permit each year, if the pool is disassembled during off-season. The fee is $5.00 per thousand of the estimated value (flat fee of $5.00).
Zoning Requirements. The LLC shall be responsible for obtaining appropriately zoned sites and maintaining zoning and land use compliance of the Facilities throughout the term of the Agreement. Pathnet shall be responsible for complying with all zoning requirements as provided by the LLC as applicable to the installation and operation of the System and its Facilities. The LLC shall advise Pathnet of zoning requirements, which, in the reasonable opinion of the LLC, differ from those generally applicable to microwave facilities. The LLC shall provide to Pathnet all required information and shall cooperate with Pathnet in connection with Pathnet's compliance with all zoning requirements pursuant to this Section 11.2. Notwithstanding the foregoing, the LLC and Incumbent shall, or shall cause Incumbent to, implement either (i) best efforts to obtain all necessary zoning and permits for each Facility or (ii) in the event Incumbent and/or the LLC are unable to obtain such necessary zoning and permits, commercially reasonable efforts to obtain an alternative facility available for installation and operation of the System in order for Pathnet to perform its obligations under this Agreement. If and to the extent the LLC and/or Incumbent cannot obtain the required zoning and permits for any Segment, Pathnet shall have, as its sole and exclusive remedy, the unilateral right but not obligation to terminate this Agreement, as to any Segment, without any further recourse against LLC or Incumbent hereunder.
Zoning Requirements. All proposed parcels, created by CSM’s, must meet the minimum requirements of their zoning dis- tricts. If these proposed parcels are not to be served by sanitary sewer, they must have a minimum of 20,000 square feet and be not less than 100 feet wide, regardless of the minimum size requirement of their zoning district. The owner must also submit a satisfactory percolation test, conducted by a certified soil tester, before the land division can be approved.
Zoning Requirements. Borrower shall not acquire, and shall not permit any of its Subsidiaries to acquire, any Finished Lot unless all proper zoning and entitlements with respect to such Finished Lot have been obtained.
Zoning Requirements. Xxxxxxxxxx’x failure to comply with any provision of the Town’s zoning ordinance shall not be treated as a default of this Agreement but as violations of a zoning ordinance requirement.
Zoning Requirements. 1. PACIS shall allow “zones” to be defined so that the information can be distributed as required within the station area. A PACIS outlet is defined as any PACIS audio loudspeaker, PACIS T-coil transmitter, or visual display. A zone is defined as any set of one or more PACIS outlets.
2. PACIS shall allow zones to be defined by PACIS operating personnel.
3. PACIS shall have, minimum, preconfigured zones:
a. One zone covering the entire station;
b. One zone covering all platforms; and
c. A separate zone for the platform area associated with each track.
4. PACIS shall support overlapping zones.
5. PACIS shall allow different information to be distributed to different zones simultaneously.
6. PACIS shall allow the same information to be distributed to different zones simultaneously.
Zoning Requirements. Surveyor must add a Zoning Information section to the Survey showing the zone designation, setback, height, parking and floor area restrictions disclosed by the zoning or building codes. Surveyor must plot all setback lines.
Zoning Requirements. Residential fences shall be a minimum of 4’ high and a maximum of 6’ high.
