Возмещение ущерба. Если Продавец производит какие-либо работы на объектах Покупателя или использует имущество Покупателя, как на территории объектов Покупателя, так и за их пределами, то Продавец гарантирует Покупателю возмещение ущерба и освобождает Покупателя от какой-либо ответственности в отношении любых обязательств, исков, требований или расходов (включая расходы на адвоката (юристов) и иные расходы на оплату услуг специалистов), возникающих в связи с нанесением вреда имуществу или причинением телесных повреждений (включая смерть) Покупателю, его работнику или любому другому лицу в процессе или в связи с осуществлением Продавцом работ или использованием имущества Покупателя, за исключением таких обязательств, исков или требований, которые возникли исключительно вследствие неосторожности Покупателя.

Возмещение ущерба. В той степени, в которой это разрешено применимым законодательством, Лицензиат соглашается возмещать, защищать и ограждать Apple, а также по запросу Apple защищать Apple, ее директоров, должностных лиц, сотрудников, независимых подрядчиков и агентов (каждый — «Сторона Apple, освобожденная от ответственности») от любых претензий, убытков, обязательств, ущерба, расходов и издержек, включая, в том числе, гонорары адвокатов и судебные издержки (в совокупности — «Убытки»), понесенных Стороной Apple, освобожденной от ответственности, и возникающих в результате или в связи с нарушением Лицензиатом или его Уполномоченным конечным пользователем каких-либо сертификатов, соглашений, обязательств, представлений или гарантий в настоящем Соглашении. Лицензиат признает, что ПО Apple не предназначено для использования в условиях, в которых ошибки или неточности в содержании, функциональности, сервисах, данных или информации, предоставленных ПО Apple, или отказ ПО Apple, могут привести к смерти, травмам или серьезному физическому или экологическому ущербу, и в той степени, в которой это разрешено законом, Лицензиат настоящим соглашается возмещать, защищать и оградить каждую сторону Apple, освобожденную от ответственности, от любых убытков, понесенных такой стороной Apple, освобожденной от ответственности, в результате любого такого использования Лицензиатом или Уполномоченными конечными пользователями.
