Право на Завершение. Если в любой момент происходит и длится Юридическое ограничение или Форс-мажор, и любой применяемый Период ожидания завершился: (А) Согласно нижеследующей статье (В) любая сторона может, посредством извещения другой стороны не более чем за 20 дней, назначить (I) день, не ранее того дня, когда такое извещение вступает в силу, Датой досрочного прекращения в отношении всех Затронутых Сделок или, (II) указав в том извещении Затронутые Сделки, в отношении которых она назначает соответствующий день Датой досрочного прекращения, день не ранее двух Рабочих Дней в отношении не всех Затронутых Сделок. После получения извещения, назначающего Дату досрочного прекращения в отношении не всех Затронутых Сделок, другая сторона может, посредством извещения назначающей стороны, если такое извещение вступает в силу в назначенную дату или до ее наступления, назначить этот же день Датой досрочного прекращения в отношении любой или всех других Затронутых Сделок. (В) Пострадавшая Сторона (если Юридическое ограничение или Случай Форс-мажора относятся к исполнению такой стороной обязательства по осуществлению любой выплаты или передачи) будет иметь право назначения Даты досрочного прекращения по Разделу 6(b)(iv)(2)(A) только в результате Юридического ограничения по Разделу 5(b)(i)(2) или Случая Форс-мажора по Разделу 5(b)(ii)(2) после предшествующего назначения другой стороной Даты досрочного прекращения в отношении не всех Затронутых Сделок согласно Разделу 6(b)(iv)(2)(A).

  • Solid Waste The Licensee shall have to make arrangements for disposal of solid waste, which shall be got removed from the premises on a daily basis to ensure perfect cleanliness as per Corporation of Chennai Norms. The Licensee shall have to make arrangements for the solid waste to be separated into glass, plastic and food waste and for the food waste to be treated in a shredder to be converted into a paste. The waste shall need to be expelled into a common dump or waste area provided/ indicated by CMRL. If solid waste is found disposed of on CMRL land or premises a penalty/fine of Rs.2000/- shall be imposed by CMRL for each occasion.

  • -234aa 1. All student records, student information, and student-generated content (collectively, "student data") provided or accessed pursuant this Agreement or any other services agreement between the Parties are not the property of, or under the control of, the Contractor.

  • Solid Waste Management General. The Airport is required by city ordinance to achieve a solid waste recycling rate of 75% by 2012 and 100% by 2020. Tenants are required to cooperate with the Airport to maximize the rate of solid waste recycling and source separation. Airport’s Work. The Airport will supply specially designed solid waste containers for depositing paper, bottles and cans, and general trash in the public areas of the terminal including Tenant public areas. The Airport will provide waste containers for public disposal of food waste and compostable serviceware in the vicinity of Food and Beverage leaseholds. Tenant’s Work. Tenants are required to collect the solid waste generated in back offices in containers designated for paper, bottles& cans, and general trash and deposit the content of each container in the designated bins at collection areas. All Food and Beverage Concessions are required to collect food waste and compostable serviceware in separate containers and deposit the contents in designated compostable materials bins at collection areas.

  • Civil Rights – General – 49 USC § 47123 The Company agrees to observe and comply with those requirements of the FAA set forth in Exhibit D, Federal Aviation Administration Required Provisions, as such requirements may be amended or interpreted by the FAA or the United States Department of Transportation from time to time. The Company shall comply with pertinent statutes, Executive Orders and such rules as are promulgated to ensure that no person shall, on the grounds of race, creed, color, national origin, sex, age, or disability be excluded from participating in any activity conducted with or benefiting from Federal assistance. If the Company transfers its obligation to another, the transferee is obligated in the same manner as the Company. This provision is in addition to that required of Title VI of the Civil Rights Act of 1964.

  • Civil Actions Except when the Joint Committee established under Article 28 considers that there has been flagrant or wilful negligence on the part of an employee, the Employer agrees not to seek indemnity against an employee whose actions result in a judgement against the Employer. The Employer agrees to pay any judgement against an employee arising out of the performance of their duties. The Employer also agrees to pay any legal costs incurred in the proceedings including those of the employee.

  • Sub-Loop In locations where SBC-AMERITECH has deployed: (1) Digital Loop Carrier systems and an uninterrupted copper loop is replaced with a fiber segment or shared copper in the distribution section of the loop; (2) Digital Added Main Line (“DAML”) technology to derive multiple voice-grade POTS circuits from a single copper pair; or (3) entirely fiber optic facilities to the end user, SBC-AMERITECH will make the following options available to CLEC:

  • Fraud, Waste, and Abuse Contractor understands that HHS does not tolerate any type of fraud, waste, or abuse. Violations of law, agency policies, or standards of ethical conduct will be investigated, and appropriate actions will be taken. Pursuant to Texas Government Code, Section 321.022, if the administrative head of a department or entity that is subject to audit by the state auditor has reasonable cause to believe that money received from the state by the department or entity or by a client or contractor of the department or entity may have been lost, misappropriated, or misused, or that other fraudulent or unlawful conduct has occurred in relation to the operation of the department or entity, the administrative head shall report the reason and basis for the belief to the Texas State Auditor’s Office (SAO). All employees or contractors who have reasonable cause to believe that fraud, waste, or abuse has occurred (including misconduct by any HHS employee, Grantee officer, agent, employee, or subcontractor that would constitute fraud, waste, or abuse) are required to immediately report the questioned activity to the Health and Human Services Commission's Office of Inspector General. Contractor agrees to comply with all applicable laws, rules, regulations, and System Agency policies regarding fraud, waste, and abuse including, but not limited to, HHS Circular C-027.
