THIS TRUST AGREEMENT OF ASSURED GUARANTY CAPITAL TRUST I (this “Trust Agreement”) is dated as of May 25, 2005 by and between Assured Guaranty US Holdings Inc., a Delaware corporation, as depositor (the “Depositor”), and The Bank of New York (Delaware), a Delaware banking corporation, as trustee (in such capacity, the “Delaware Trustee”).
