Moody’s, Fitch and DBRS to the extent each such rating agency rates the insurance company and is rating the securities secured by the related Mortgage Loan). The Mortgage Loan documents permit “all risk” or “special perils” insurance providing for no deductible in excess of $500,000 or such higher deductible if the Mortgagor provides the Mortgagee with cash or a letter of credit in an amount equal to the difference between the actual deductible and $500,000. In the event the sponsor of the related Mortgagor does not own, in the aggregate, at least 20% of the direct or indirect interests in the Mortgagor or does not control Mortgagor (a “Control Event”), the insurance coverage may require a deductible of no greater than $100,000.
