Contract Type FiledMay 2nd, 2021During the Term of the Order Form, the Platform will be operational and available to Customer and its Members at least 99.5% of the time in any calendar month (“Performance Commitment"). If Achievers fails to meet the Performance Commitment, and if Customer meets its obligations under the Agreement, including being current in all payments due, Customer will be eligible to receive the Credit defined below for failure to meet the Performance Commitment. This Credit is Customer’s sole and exclusive remedy for any failure by Achievers to meet the Performance Commitment.
