THIS DEVELOPMENT AGREEMENT (this “Agreement”), is made and entered into as of November 22, 2019 (the “Dated Date”), by and between the CITY OF WICHITA, KANSAS, a municipal corporation duly organized under the laws of the State of Kansas (the “City”), and DOUGLAS MARKET DEVELOPMENT, LLC, a Kansas limited liability company (“DMD”), an Affiliate Entity (as hereinafter defined) specifically for all or a Principal Component (as hereinafter defined) of this development, or assignees permitted by the terms of this Agreement (collectively, the “Developer”) (the Developer and the City are collectively referred to as the “Parties” and each a “Party”).
