THIS DEVELOPMENT AGREEMENT (the "Agreement") is made and entered into on the 28th day of May, 2019, by and between the CITY OF BELMONT, a municipal corporation ("City"), and WINDY HILL PV FOURTEEN MF LLC, a California limited liability company ("Land Owner"), under the authority of Sections 65864 – 65869.5 of the California Government Code and Section 28 of the Belmont Zoning Ordinance. The City and the Land Owner are, from time to time, individually referred to in this Agreement as a "Party" and collectively referred to as the "Parties."
