This Development Agreement (this "Agreement") is executed among B&M PROPERTIES, JOINT VENTURE a Texas Joint Venture (“B&M”), herein referred to as the "Owner", which as used herein shall include the current owners of the Property and their successors and permitted assigns), and the City of Justin, Texas, a general law city (the "City") (Owner and City being referred to individually as a "Party" and collectively as the "Parties"), to be effective on the Effective Date as defined in Section 12.10.
