Contract Type FiledSeptember 28th, 2021The power to transfer a pupil to off-site provision for behavioral reasons is set out in Section 29A of the Education Act (2002) and the Education (Education Provision for Improving Behavior) Regulations 2010. Department guidance “Alternative Provision: Statutory Guidance for Local Authorities” (2013), makes it clear that the Head Teacher is authorised to make such a decision without reference to the Governors, but I can confirm to you that the Governing Body has delegated the authority to make this referral to the Head Teacher.
