THIS VILLAGES OF TORTOLITA DEVELOPMENT AGREEMENT (this “Agreement”) is made and entered into by and between the TOWN OF MARANA (the “Town”), an Arizona municipal corpora- tion; and TMR INVESTORS, LLC (“TMR”), an Arizona limited liability company. The Town and TMR are sometimes collectively referred to as the “Parties,” either of which is sometimes individ- ually referred to as a “Party.”
