This PLANNING FUNDING AGREEMENT (“Agreement”) is made this day of , 200_, by and between the City of Overland Park, a municipal subdivision of the state of Kansas (“Incumbent”), having an address of 12400 Foster, Overland Park, KS 66213, and Nextel Operations, Inc., a wholly owned indirect subsidiary of Sprint Nextel Corporation, a Delaware corporation (“Nextel”) having an address of 2001 Edmund Halley Drive, Reston, VA 20191. Nextel and Incumbent may be referred to collectively in this Agreement as the “Parties.”
