entered into as of this day of 2016, by and between the CITY OF ANAHEIM, a charter city and a municipal corporation duly organized and existing under the Constitution and the laws of the State of California (“City”), and SAGECREST, LLC, a California limited liability company (“Developer”), pursuant to the authority set forth in Section 65867 of the California Government Code, and the general authority set forth in section 65864 et seq. of the Government Code (the “Development Agreement Act”), the City’s inherent power as a charter city, and the Development Agreement Act implementing procedures adopted by the City in Resolution No. 82R-565 (the “Procedures Resolution”). The definitions contained in Section 1 shall apply to the entire Agreement, including the following RECITALS.

The definitions contained in Section 1 shall apply to the entire Agreement, including the RECITALS.
