In the case under review, the members of ʿĀʾilat ʿAbd al-Qādir assemble and agree upon building a road up to the school of al-Sawāḥira al-Sharqiyya. The road is required for essen- tial public purposes, such as the transportation of sick persons, the water supply and school- children. The road is intended only for the members of that ʿāʾila (approximately three hundred persons), each family within the ʿāʾila sharing in the expenses in accordance with the number of its members. All the partners to the agreement are required to take action against owners of the fences hindering the building of the road, to the point of removing those fences by force. Whoever refuses to pay toward the cost of the road will be forbid- den to use the road. Moreover, whoever infringes the provisions of the agreement shall be regarded as disassociated from the ʿāʾila with all the consequences involved.
