TRIBAL AGREEMENT ON THE BUILDING OF A PUBLIC ROAD (1965)

In the case under review, the members of ʿĀʾilat ʿAbd al-Qādir assemble and agree upon building a road up to the school of al-Sawāḥira al-Sharqiyya. The road is required for essen- tial public purposes, such as the transportation of sick persons, the water supply and school- children. The road is intended only for the members of that ʿāʾila (approximately three hundred persons), each family within the ʿāʾila sharing in the expenses in accordance with the number of its members. All the partners to the agreement are required to take action against owners of the fences hindering the building of the road, to the point of removing those fences by force. Whoever refuses to pay toward the cost of the road will be forbid- den to use the road. Moreover, whoever infringes the provisions of the agreement shall be regarded as disassociated from the ʿāʾila with all the consequences involved.

TRIBAL AGREEMENT OF CONFIDENTIALITY (PRIOR TO FILING A CHILD IN NEED OF AID CASE)

Prior to filing a Child-in-Need-of-Aid (“CINA”) case in state court, the Office of Children’s Services (“OCS”) may provide information to Alaska tribes regarding child protection investigations that involve their tribal children. This information sharing may occur for any of the following reasons: so that a Tribe may work collaboratively with OCS to investigate allegations of child abuse and neglect; so that a Tribe can aid in providing services or placing a child if releasing the information is in the child’s best interest; or a Tribe has requested the information from OCS and indicates the request is for a purpose related to child protection, including investigating the allegations in the Protective Services Reports (“PSR”). In addition to the PSR, information sharing at this stage may include reports of harm, ORCA notes, safety plans, police reports, and other investigative reports.

TRIBAL AGREEMENT ON REGULATIONS RELATING TO CORN THEFT (1949)

According to tribal customary law, all kinds of theft are in principle allowed if they are committed outside the tribal territory (dīra) against hostile tribes. Actually, under such circumstances, the theft is tantamount to a legitimate raid (ghazw), rather than an offense against property, which entails punishment. Within the tribal territory, the right of property is defended. The owner of the stolen property can demand, through tribal legal proceed- ings, the restitution of his property in kind or, if not available, in monetary compensation in addition to a fine. Moreover, the theft can be punished by corporal punishment, such as cutting off the hand or even the death penalty.1
