THIS MASTER SOFTWARE AS A SERVICE SUBSCRIPTION AGREEMENT, is dated as of the date of, in the case of any Evaluation Software (as defined in Section 16 below), the date Kiuwan provides Customer with temporary evaluation access to the Licensed Software, or in the case of any purchase of a SaaS subscription for use of the Licensed Software (as defined below), the date of the Purchase Order (as defined below) pursuant to which such subscription is purchased, is between Kiuwan Software S.L., a company organized under the laws of Spain (“Kiuwan”), and, in the case of any Evaluation Software, the customer to whom Kiuwan provides temporary evaluation access to the Licensed Software or, in the case of any purchase of a SaaS subscription for use of the Licensed Software, the customer set forth on the purchase order pursuant to which such subscription is purchased (in each case, herein “Customer”), and sets forth the terms and conditions whereby Kiuwan agrees to provide to Customer for a limited
