This Development Agreement (“PTPIII Project DA”) dated for reference purposes only as of , 2018, is entered into by and between the City of Foster City, a California municipal corporation (“City”) and Pilgrim Triton Phase III FC LP, a Delaware limited liability partnership (“Developer”), pursuant to section 65864 et seq. of the California Government Code. City and Developer may be collectively referred to herein as a “Party,” and collectively as the “Parties.”
