Contract Type FiledJune 15th, 2015[1] This award addresses the grievance of Dr. Amanda Zavitz-Gocan, a professor in the School of Language and Liberal Studies, alleging that the college discriminated against her on the basis of family status and failed to accommodate her, contrary to Article 4 of the Collective Agreement and Section 5(1) and 11 of the Ontario Human Rights Code, R.S.O 1990, c.H.19 (as amended) (the Code). The grievor has two children who at the time of the grievance were seven and four. One of the children has significant health issues. It is the union’s position that the grievor has suffered serious adverse effects because the college has scheduled her increasingly in early morning and evening classes outside of the hours that daycare covers. She spoke to the chair of her school and advised him of her difficulties in finding reliable childcare when she was scheduled for an 8 a.m. class or after 5 p.m. The chair told her that the college did not approve scheduling exceptions for childcare.
