This Second Amendment (“Amendment No. 2”) to the Tax Increment District No. 4 Development Agreement (“Agreement”) is made and entered into as of this day of , 2011, by and between Oak Street #1, LLC (“Developer”), and E.J. Plesko and Associates, Inc. and Fitchburg Pines Apartments, LLC (“Guarantor”), and the Village of Grafton, a Wisconsin municipal corporation (“Village”), and the Village of Grafton Community Development Authority, a quasi-governmental body organized and existing under Section 66.1335 of the Wisconsin Statutes (“CDA”).
