This non-exclusive Digitization Agreement (the “Agreement”), is entered into as of February 13, 2024 (the “Effective Date”), by and between Cengage Group Inc. (“Cengage”), along with its subsidiaries and affiliates, and the National Archives and Records Administration, an independent agency in the executive branch of the United States Government with its headquarters in Washington, DC (“NARA”) (with each of Cengage and NARA being referred to as a “party” or collectively as the “parties”).
