THIS DEVELOPMENT AGREEMENT (the "Agreement"), made on 2016 is by and among the South Bend Redevelopment Commission, governing body of the South Bend Department of Redevelopment (the "Commission"); the South Bend Economic Development Commission, a separate body corporate and politic and an instrumentality of the City (as hereinafter defined) (the "EDC"); and Kite Realty Group, L.P, a Delaware limited partnership (the "Developer") (each sometimes being referred to herein as a "Party" or collectively as the "Parties").
