This Development Agreement (hereinafter the “Agreement”) is made and entered into as of the day of 2018, by and between CDG Fenton, LLC, a North Carolina limited liability company ( “CDG Fenton”), and the TOWN OF CARY, North Carolina, a municipal corporation of the State of North Carolina (the “Town”). CDG Fenton and the Town may sometimes be referred to individually as a “Principal Party” and collectively as the “Principal Parties.”
