This PLANNING FUNDING AGREEMENT (“Agreement”) is made this day of , 2013 (“Effective Date”), by and between the City of El Paso, a political subdivision of the State of Texas (“Incumbent”), and Nextel Operations, Inc., a wholly owned indirect subsidiary of Sprint Corporation, a Delaware corporation (“Sprint”). Sprint and Incumbent may be referred to collectively in this Agreement as the “Parties.”
