This is a legal agreement between the municipality and its consultant in order to progress a federally aided project; the NYS Department of Transportation is not a party to this agreement. This model agreement does not take into account any Local governmental requirements, procedures and contracting practices that might apply and would result in additions or modifications (as long as they do not conflict with federal or State required provisions). Accordingly, review of this agreement form is recommended by the appropriate contracting officials and/or Legal Counsel for the municipality.
