THIS DEVELOPMENT AGREEMENT (the “Agreement”) is made and entered into as of this day of 2019, by and between TOWN OF BAY HARBOR ISLANDS, a Florida municipal corporation (hereinafter, the “Town”), and N/R WHARTON KANE CONCOURSE PROPERTY OWNER, LLC, a Delaware limited liability company (hereinafter, the “Owner”) (the Town and Owner are together referred to as the "Parties").
