This Blanco River Ranch (Phase Two Residential - Savannah District Area) Development Agreement (this “Agreement”) is entered into between the CITY OF KYLE, a Texas home rule city and municipal corporation (the “City”), BLANCO RIVER RANCH PROPERTIES LP, a Texas limited partnership, or its successors and assigns (“Seller”) and TOLL SOUTHWEST, LLC, a Delaware limited liability company, or its successors and assigns (“Purchaser”). In this Agreement, the City, Seller and Purchaser are sometimes individually referred to as “a Party” and collectively referred to as “the Parties”.
