Redistribution agreements, initially adopted to prevent co-ownership, have evolved to accommodate testators' wishes and comply with legal provisions. These agreements cannot contravene common law rules, ensuring that explicit will provisions remain unaltered. However, this rule is not always strictly applied. In cases where beneficiaries enter into agreements varying or modifying will terms, these are invalid unless sanctioned by the court. Common law permits redistribution agreements to redistribute assets acquired through inheritance or bequest, but alters the will's or intestate succession's provisions in doing so. A notable exception exists for unfeasible bequests, where a testator's gift is deemed void if it becomes impossible to fulfill (e.g., when multiple houses are built on a single piece of land).
