Vaccines should be shipped directly to vaccination settings to minimize breaks in the cold chain. However, there may be circumstances where COVID-19 vaccines need to be routinely moved to additional clinic locations responsible for vaccine administration. In these instances, healthcare organizations, third-party vendors, and vaccination providers—primary organization or secondary location—must apply and receive authorization from the California Department of Public Health (CDPH) to routinely redistribute COVID-19 vaccines to other provider locations.

A redistribution agreement can be a useful alternative to the other methods of liquidation of a deceased estate. In particular circumstances, the application of a redistribution agreement can obviate the undesirable consequences of co- ownership or unpractical allocation of assets to the detriment of beneficiaries, which may even give rise to hardship. It is a unique arrangement in the sense that it is something more than a stereotype contract where the beneficiaries, and in appropriate instances a surviving spouse, may freely contract with each other, but may encompass elements of sale, exchange or donation that could serve as “vehicles” for the reallocation of assets. It must be the intention of the parties to re-allocate their vested rights in the estate assets concerned and, to a certain extent, “trade” with these rights.

Furthermore, when immoveable property is involved, Section 2(1) of the Alienation of Land Act also provides that, if immovable property is involved in such redistribution, then it must be in writing. A similar test was also applied in the Klerck case (see discussion supra). It must, however, be noted that where a bequest is unfeasible, for example where a testator bequeaths a house to each of his children and after his death it becomes evident that all the houses are built on one piece of land and the subdivision of such land is not permissible, such bequest is void and the land will be regarded as part of the remainder of the estate and will devolve upon whoever is entitled to such remainder (see Ex parte Adams NO 1964 SA 135 CPD). However, in terms of section 14(1)(b)(iii) of the Act, a departure from this general rule may be taken by means of a redistribution agreement which may be entered into between the heirs and legatees of a deceased estate, and/or between such heirs and the su

Redistribution agreements, initially adopted to prevent co-ownership, have evolved to accommodate testators' wishes and comply with legal provisions. These agreements cannot contravene common law rules, ensuring that explicit will provisions remain unaltered. However, this rule is not always strictly applied. In cases where beneficiaries enter into agreements varying or modifying will terms, these are invalid unless sanctioned by the court. Common law permits redistribution agreements to redistribute assets acquired through inheritance or bequest, but alters the will's or intestate succession's provisions in doing so. A notable exception exists for unfeasible bequests, where a testator's gift is deemed void if it becomes impossible to fulfill (e.g., when multiple houses are built on a single piece of land). In such cases, the land devolves to the entitled remainder of the estate. Redistribution agreements must be in writing and comply with contract requirements. Those involving immovab

Parties to a redistributed agreement In terms of section 14(1)(b)(iii) of the Act, a redistribution agreement can be entered into in between heirs and legatees, including ascertained and competent fideicommissary heirs and legatees. The executor need not be a party to a redistribution agreement (see RCR 34 of 2005). To enter into a redistribution agreement, the heirs and legatees must have vested rights, and not merely a spes (see Leach v Champion Estates Ltd 1956 (3) SA 674 (O)). This is not true with regard to the rights of fideicommissary heirs, as section 14(1)(b)(iii) specifically provides that they may be a party to such agreement. 6.1 Surviving spouse as a party To be competent to enter into a redistribution agreement, the surviving spouse must also be an heir or legatee in the estate of the deceased or a joint estate must be involved (see Chief Registrars Circular No 10 of 1969). 6.2 Unascertained heirs A redistribution agreement where unascertained heirs are involved (for exam

A Redistribution Agreement is an agreement entered into by and between the heirs (testate or intestate) or legatees, and in some instances the surviving spouse, of a deceased estate in terms whereof they agree to equitably vary the bequest(s) made in the deceased’s Will; or in terms whereof they equitably vary the distribution of the estate in terms of intestate succession, as they see fit. Although it is not a requirement, the Executor of the estate may also be a party to the agreement, in his/her capacity as Executor. The heirs or legatees cannot enter into a redistribution agreement with persons who are not heirs or legatees or the surviving spouse(s) to the estate. For example, a trust, a company, or a close corporation having no right of inheritance from the estate (for example by will), albeit the heirs being trustees, beneficiaries, directors, or members of such entities, cannot be a party to Redistribution Agreement. In terms of the provisions of the Deeds Registries Act, 47 of

One. Introduction Land transfers and transfers of actual rights must follow the sequence of successive transactions in which they are conducted and it will not be legal to depart from such a sequence, except as provided for in the Records of Deeds Act 1937 (hereafter called law), or in any other statute or as ordered by the court (article 14 (1)a) and (b) of the Act.) However, section 14(1)(b)iii) of the Act provides for a departure from this general rule, where a redistribution agreement is reached between the heirs and the legatees (including the heirs and qualifiicommissary heirs determined) of the deceased, or between these heirs and legatees and the surviving spouse, including the holder of a personal easement being also heir (see RCR 12 of 2006). Redistribution may involve the entire portion or any part of the assets of that estate. Article 14(1)b)(iv) further provides that it is legal to introduce personal property that is not part of the estate for the purpose of equalizing the
