THIS DEVELOPMENT AGREEMENT (this “Agreement”), dated as of November , 2016 (the “Effective Date”), is made by and among the CITY OF MADISON, a Wisconsin municipal corporation (the “City”), and GEBHARDT DEVELOPMENT, LLC, a Wisconsin limited liability company (“Gebhardt”), and AMERICAN FAMILY MUTUAL INSURANCE COMPANY, a Wisconsin mutual insurance corporation (“American Family”) (Gebhardt and American Family together referred to as the “Developers”, and each a “Project Element Developer”).
