This Development Agreement (“Agreement”) is entered into between the developer Highland Gate Itasca LLC, a Delaware Corporation authorized to do business in Illinois (“Developer”) and the Village of Itasca, an Illinois Municipal Corporation (“Village”) regarding the future maintenance of the improvements at the townhome project located at the Property, as hereinafter defined (the “Project”). The effective date of this Agreement will be the date that this Agreement is executed by both parties (the “Effective Date”).
