This Development Agreement for the Edgewood Development (this “Agreement”) is made and entered into, effective as of the day of , 2022 (the “Effective Date”), by and between the City of Leander, Texas, a Texas home rule municipal corporation (the “City”), M/I Homes of Austin, LLC, an Ohio limited liability company (the “Developer”), and Cannon 140 LP, a Texas limited partnership (the “Landowner”). The Landowner is joining this Agreement solely for the purpose of consenting to the development of the Property pursuant to the terms and conditions contained in the Agreement. The City and the Developer are sometimes referred to herein collectively as the “Parties” and individually as a “Party”. The Parties agree as follows.
