THIS DEVELOPMENT AGREEMENT (the “Development Agreement”) is made and entered into this 5th of October, 2020, (the “Record Date”), by and among the City of Coalinga, a municipal corporation organized and existing under the laws of the State of California (the “City”), and Estate of Mine, LLC, a California limited liability company (“Owner”), and Coalinga Retail Partners, LLC, a California limited liability company (“Developer”)]. The Parties to this Development Agreement may be referred to hereinafter individually as a “Party” or jointly as the “Parties.”
