This agreement made this day of , 2023, by and between the Town of Mount Airy, a municipal corporation of the State of Maryland, party of the first part (hereafter the “Town”) and Mt. Airy Ridge, LLC, a Maryland limited liability company (hereafter collectively “Owner”), party of the second part. Reference to “Owner” herein shall be construed to include “Developer”, and vice-versa. The Town and Owner/Developer shall collectively be referred to as the “Parties”. Sandy Spring Bank executes this Public Works Agreement for the sole purpose of subordinating its rights to those of the Town as set forth herein.
