THIS SUBAWARD AGREEMENT (“Agreement”) is entered into as of , by and between Trout Unlimited, a nonprofit corporation with principal offices at 1777 N. Kent Street, Suite 100, Arlington, VA 22209 (“Trout Unlimited” or “TU”), and the Windy Gap Water Activity Enterprise, a government-owned business within the meaning of Article X, § 20(2)(d) of the Colorado Constitution and a water activity enterprise organized pursuant to the provisions of Title 37, Article 45.1 of the Colorado Revised Statutes, as amended, , at 220 Water Avenue, Berthoud, CO 80513 (“Enterprise”).
