THIS DEVELOPMENT AGREEMENT (this “Agreement”) is entered into this day of , 2017 by and between Midas Lenexa, LLC a Missouri limited liability company (the “Developer”), and the City of Lenexa, Kansas, a Kansas municipal corporation (the “City”). The Developer and the City are sometimes hereinafter collectively referred to as the “Parties”, and each a “Party”. This Agreement pertains to and affects the establishment of a Community Improvement District (“CID”) for the purpose of financing a portion of the CID Project (as defined herein) pursuant to the terms and provisions set forth below:
