THIS DEVELOPMENT AGREEMENT (this “Agreement”) is made and entered into by and be- tween the TOWN OF MARANA, an Arizona municipal corporation (the “Town”), and LKB RANCH, LLC, an Arizona limited liability company (“LKB Ranch”), LKB HOTEL, LLC, an Arizona lim- ited liability company (“LKB Hotel”), and LKB RETAINED LAND, LLC (“LKBRL”), an Arizona limited liability company. LKB Ranch, LKB Hotel, and LKBRL are collectively referred to as the “Owner.” The Town and the Owner are sometimes collectively referred to as the “Parties,” any of which is sometimes individually referred to as a “Party.”
