Pursuant to that certain Unallocated Bullion Account Agreement, dated November 12, 2004, as amended by Amendment No. 1, dated November 26, 2007, and Amendment No. 2, dated May 20, 2008 (the “Original Agreement”), we agreed to open and maintain for you an Unallocated Account and to provide other services to you in connection with your Unallocated Account. You and we now wish to amend and restate the Original Agreement to incorporate into one document the Original Agreement and the above amendments and to make further amendments. This Agreement now sets out the terms under which we will provide those services to you and the arrangements which will apply in connection with those services and your Unallocated Account.
