THIS INVESTMENT ADVISORY AGREEMENT (the “Agreement”) is made as of the 1st day of September 2023, by and between Calamos ETF Trust (the “Trust”) on behalf of each series set forth on Schedule A attached hereto (each, a “Fund”), and Calamos Advisors LLC (the “Advisor”).

This Amendment to the Administration Agreement is made as of September 26, 2023 (the “Amendment”) by and between State Street Bank and Trust Company, a Massachusetts trust company (the “Administrator”) and each registered management investment company identified on Schedule A hereto (each, a “Trust). Capitalized terms used in this Amendment without definition shall have the respective meanings ascribed to such terms in the Agreement (as defined below).

This first amendment (“Amendment”) to the ETF Distribution Agreement (the “Agreement”) dated as of December 16, 2022, by and between Calamos ETF Trust and Foreside Fund Services, LLC (together, the “Parties”) is effective as of September 1, 2023.
