This EMPLOYMENT AGREEMENT (this “Agreement”) is made and entered into this 13th day of December, 2022 to be effective as of January 1, 2023 (the “Effective Date”), between New York Mortgage Trust, Inc., a Maryland corporation (the “Company”), and Nicholas Mah (the “Executive”). The Executive and the Company are each referred to herein as a “Party” and collectively as the “Parties.”
