⮚ Comment. Most restrictive covenants refer to the party to be bound simply as Employee. This practice imparts a mass-produced flavor to the agreement that suggests a contract of adhesion and does not further the employer’s interest in enforcement. It makes sense for the employer to go to the small extra effort of referring to the employee by name throughout the agreement and making sure personal pronouns are gender-specific.
