THIS AGREEMENT (“Agreement”) is entered into by and between THE CENTERS FOR MEDICARE & MEDICAID SERVICES (“CMS”), as the Party (as defined below) responsible for the management and oversight of the Federally-facilitated Small Business Health Options Programs (“FF-SHOPs”) and the use of the Federal eligibility and enrollment platform by the State-based Exchanges on the Federal Platform that use HealthCare.gov for SHOP Exchange
