Purpose: To inform you that, pursuant to Section 274b. of the Atomic Energy Act of 1954, as amended (Act), entitled “Cooperation with States,” the Commission on September 2, 2009, approved an Agreement with the State of New Jersey. Under the Agreement, the State will assume certain regulatory authority over byproduct material in Sections 11e.(1), 11e.(3), and 11e.(4) of the Act, source material, special nuclear material in quantities not sufficient to form a critical mass, and the regulation of land disposal of byproduct, source, or special nuclear waste materials received from other persons. The Agreement became effective September 30, 2009.

NRC IMPLEMENTATION OF THE EPA-NRC MEMORANDUM OF UNDERSTANDING (STP-04-026)

On October 9, 2002, the U.S. Nuclear Regulatory Commission (NRC) and the U.S. Environmental Protection Agency (EPA) entered into a Memorandum of Understanding (MOU) on "Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites." (http://www.nrc.gov/reading-rm/doc-collections/news/2002/mou2fin.pdf). Under the MOU, EPA agrees to continue its Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) deferral policy of not listing sites on the National Priorities List that are subject to NRC’s licensing authority. The MOU also expands EPA's deferral to sites for which the NRC license is terminated and certain criteria are met. Specifically, the MOU provides that unless an NRC-licensed site exceeds any of three trigger criteria, EPA agrees to a policy of deferral to NRC decision-making on decommissioning without the need for consultation.

COMMONWEALTH OF PENNSYLVANIA AGREEMENT (FSME-08-031)

For your information, pursuant to Section 274b. of the Atomic Energy Act of 1954, as amended (Act), entitled “Cooperation With States,” the Commission on February 12, 2008, approved an Agreement with the Commonwealth of Pennsylvania. Under the Agreement, the Commonwealth will assume certain regulatory authority over byproduct material in Sections 11e.(1), 11e.(3), and 11e.(4) of the Act, source material, special nuclear material in quantities not sufficient to form a critical mass, and land disposal of all waste for such materials. The Agreement becomes effective March 31, 2008.

For your information, pursuant to Section 274b. of the Atomic Energy Act of 1954, as amended (Act), entitled “Cooperation With States,” the Commission on January 26, 2006, approved an Agreement with the State of Minnesota. Under the Agreement, the State will assume certain regulatory authority over byproduct material in Section 11e.(1) of the Act, source material, and special nuclear material in quantities not sufficient to form a critical mass. The Agreement becomes effective March 31, 2006.

Effective January 25, 2005, Dr. Josephine Piccone was appointed as Executive Assistant/Chief of Staff for Commissioner Peter B. Lyons. Dr. Piccone joined the NRC in 1985 as a Health Physicist in Region I. In 1990, she moved to Headquarters as a Senior Project Manager in the Office of Nuclear Material Safety and Safeguards (NMSS). Since 1993, she has held a number of supervisory and management positions in NMSS, including Section Leader; Chief, Operations Branch; Chief, Rulemaking and Guidance Branch; Deputy Director, Division of Fuel Cycle Safety and Safeguards; Deputy Director, Division of Industrial and Medical Nuclear Safety; and Deputy Director, Division of Waste Management. In 2002, she was appointed as Deputy Director, Office of State and Tribal Programs (STP). Dr. Piccone earned a B.S. degree in Chemistry from Daemen College, a M.S. degree in Radiological Health and a Ph.D. in Medical Radiation Physics from Temple University.
