Whereas, the Department of Natural Resources and Environmental Control (Department), an agency of the State of Delaware, has established certain regulations applicable to the Grantor, requiring that an Owner or Operator of an aboveground storage tank (AST) shall provide assurance that funds will be available when needed for corrective action and third-party compensation for Bodily Injury and Property Damage caused by Accidental Releases arising from the operation of the AST. The attached Schedule lists the number of ASTs at each Facility and the name(s) and address(es) of the Facility(ies) where the ASTs are located that are covered by the standby trust agreement.
