Air pollution caused by haze has become an annual event in Southeast Asia, the cause is a forest fire that occurred almost in every dry season in Sumatra and Kalimantan. Transboundary haze pollution is considered being common to the countries in ASEAN, because the impact caused by smoke pollution is not only plagued the country (Indonesia), but also other ASEAN member countries. Another consequence of this pollution is the emergence of diplomatic tensions between Indonesia as polluter toward other countries that affected by the pollution. To overcome these problems, ASEAN form regulations regarding transboundary haze pollution through the ASEAN Agreement on Transboundary Haze Pollution (AATHP) which begin effective since 2003 and has been ratified by all members of ASEAN in 2014. Transboundary Haze Pollution that caused by forest fires has become a not only a national problem, but also regional. The impacts of the haze has threatened the stability of security, economy and the lives of individuals mosts of ASEAN countries. However, the basis for the action requested a State responsibility against the State that comtaminated other countries, with their activities. With the signinig of this agreement, the ASEAN countries all agreed, and devolped the basis of a cooperation to prevent, monitor of all kind of transboundary air pollution caused by forest fire. This is more in agreement orient the responsibilities among ASEAN member countries in dealing with smog pollution .. As for the rules relating to the enforcement mechanisms, dispute resolution or sanctions are not specifically listed in the agreement.

Transboundary haze pollution is an almost annual occurrence in Southeast Asia. Haze originates from peat and forest fires mostly in Indonesia, with Malaysia and Singapore suffering the worst of its effects. Most of these fires are manmade, and linked to land clearing activities of local and foreign commercial oil palm plantations. The regional nature of the haze has resulted in a concentration of haze mitigation activities at the Association of Southeast Asian Nations (ASEAN) level. However these initiatives continually fail to effectively mitigate haze. This article argues that this is due to the influence of patronage politics in the sector. This is linked to the ASEAN style of regional engagement, which prioritizes the maintenance of national sovereignty. States are compelled to act in their national interests, as opposed to the collective regional interests.
